Salary Sacrifice Australia: How It Affects Your Minimum Wage Check
The national minimum wage from 1 July 2026 is $26.44 per hour or $1,004.90 per week for adult award-free employees, and salary sacrifice does not reduce this obligation.
Salary Sacrifice Australia: A Practical Minimum Wage Check
Salary sacrifice is a common arrangement in Australian workplaces where an employee agrees to forgo part of their gross salary or wages in exchange for benefits such as a car, additional superannuation contributions, or electronic devices. While salary sacrifice can reduce your taxable income, it does not change the fundamental obligation your employer has to pay at least the legal minimum wage. This guide explains how to check your pay against the floor when you have a salary sacrifice arrangement.
The Legal Minimum Wage Floor
The Fair Work Commission sets the national minimum wage each year. From 1 July 2026, the adult national minimum wage for award-free employees is $26.44 per hour or $1,004.90 per week. For casual employees receive a casual loading of 25% loading, making the casual hourly rate $33.05 per hour. These rates apply to national-system employees who are not covered by a modern award or enterprise agreement. A modern award or enterprise agreement can require a higher rate than the national minimum, and that higher rate becomes the minimum.
It is important to note that not every worker must receive exactly $26.44 per hour. Junior employees (under 21) have lower percentages of the adult rate, ranging from 36.8% for under 16 to 97.7% for 20-year-olds. Apprentices and trainees follow the Miscellaneous Award rates, not the junior percentages. The Fair Work Ombudsman explains and enforces these rules, but the Fair Work Commission sets the rate.
How Salary Sacrifice Interacts with the Minimum Wage
Salary sacrifice is a post-tax arrangement that reduces your taxable income, but it does not reduce your gross ordinary-time earnings for minimum wage purposes. Your employer must still pay you a gross wage that meets or exceeds the applicable minimum. If your salary sacrifice reduces your cash pay below the minimum wage, that arrangement is unlawful. The minimum wage is a floor on gross earnings, not net take-home pay.
For example, if you earn $30.00 per hour gross and salary-sacrifice $5.00 per hour into a car, your cash pay is $25.00 per hour. But your gross wage is still $30.00 per hour, which is above the $26.44 minimum. However, if your gross wage were only $26.44 and you salary-sacrificed $2.00, your cash pay would be $24.44, which is below the minimum. That is not allowed because the gross wage must be at least $26.44. The sacrifice cannot bring the gross below the floor.
Separating the Legal Minimum from Other Figures
It is helpful to distinguish the legal minimum from survey averages and negotiated salaries. The ABS May 2026 survey reports full-time adult ordinary-time earnings of $2,083.70 per week and all employees average total earnings of $1,579.20 per week. These are averages, not minimums. Many employees earn above the minimum due to awards, enterprise agreements, or individual negotiation. Salary sacrifice is often used by employees earning above the minimum to reduce tax, but it is not available to those earning only the minimum because there is no room to sacrifice without falling below the floor.
Superannuation is an employer payment on top of your ordinary-time earnings. The super guarantee is 12% of your ordinary-time earnings, paid on top of your gross wage. Salary sacrifice into super can increase your super balance, but the mandatory 12% is calculated on your ordinary-time earnings before any sacrifice. If you salary-sacrifice additional super, those extra contributions are on top of the 12% guarantee.
Practical Check: Compare Your Hourly Rate
To check if your pay meets the minimum, find your gross hourly rate (before any salary sacrifice). If you are award-free and adult, compare it to $26.44 per hour. If you are covered by a modern award, check the award classification rate. The award backstop from 1 July 2026 is $26.44 per hour for ongoing employees, with an introductory rate of $25.74 per hour for the first six months. If your gross rate is below the applicable minimum, your employer is underpaying you, regardless of any salary sacrifice arrangement.
Salary sacrifice does not change the comparison. The gross rate is the figure that must meet the minimum. If you are unsure about your award coverage, consult the Fair Work Ombudsman or your union. This site provides orientation only and is not a pay determination or legal advice.

Questions people ask next
Does salary sacrifice reduce the minimum wage I must be paid?
No. Salary sacrifice is an agreement to forego part of your gross salary in exchange for benefits (e.g., a car, super contributions above the guarantee). The minimum wage obligation is based on your gross ordinary-time earnings before any sacrifice. Your employer must still pay at least the national minimum wage or applicable award rate, and salary sacrifice cannot bring your cash pay below that floor.
How do I check if my salary-sacrificed pay meets the minimum wage?
Compare your gross hourly rate (before salary sacrifice) to the relevant minimum. For award-free adults from 1 July 2026, that is $26.44 per hour or $1,004.90 per week. If you are covered by a modern award, the award rate may be higher. Salary sacrifice only affects your net pay and tax, not the gross wage used for minimum wage compliance.
Does salary sacrifice affect my super guarantee?
Yes, but only if the sacrifice is directed into super above the 12% guarantee. The super guarantee is calculated on your ordinary-time earnings (usually your gross salary before any sacrifice). If you salary-sacrifice additional super, those extra contributions are on top of the mandatory 12% and do not reduce the minimum wage or the super guarantee base.
